Terms of Service

1. Definitions

• "BnBFlows" — the platform, company and services operated by BnBFlows Ltd.
• "Customer" / "you" — the individual or business entity that registers for and uses BnBFlows.
• "Tenant" — a Customer's isolated workspace within the multi-tenant platform.
• "End User" — guests, staff members and other individuals whose data is managed within the platform by a Customer.
• "Content" — property listings, images, guest records, booking data and any other information you upload or create in BnBFlows.

2. Account Registration

To use BnBFlows, you must:

• Be at least 18 years old and have legal authority to enter into this agreement.
• Provide accurate and complete registration information and keep it updated.
• Maintain the security of your password and not share account credentials.
• Notify us immediately at support@bnbflows.com if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account, whether or not you authorised it.

3. Subscription & Billing

Plans & Fees

BnBFlows offers subscription plans as described on our Pricing page. All fees are stated in USD or KES as applicable and are exclusive of applicable taxes.

Free Trial

New Customers receive a 14-day free trial with access to all features. No credit card is required to start. At the end of the trial, you must subscribe to continue using the platform.

Payment

• Subscriptions are billed monthly or annually in advance.
• Payments are processed via our payment partners. By providing payment details you authorise recurring billing.
• All fees are non-refundable unless otherwise stated or required by law.

Price Changes

We may change subscription prices with 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.

4. Acceptable Use

You agree not to use BnBFlows to:

• Violate any applicable law, regulation or third-party rights.
• Upload malicious code, malware or any content intended to harm the platform or other users.
• Attempt to gain unauthorised access to any part of the platform or other Customers' data.
• Use the platform to send unsolicited communications (spam) to guests or staff.
• Reverse-engineer, decompile or disassemble any part of the platform.
• Scrape, crawl or extract data from the platform using automated tools without our written consent.
• Impersonate BnBFlows, its employees or another user.
• Store or process data that you do not have the right to use.

We reserve the right to suspend or terminate accounts that violate this section without prior notice.

5. Intellectual Property

BnBFlows and its underlying software, branding, design, trademarks and documentation are the exclusive property of BnBFlows Ltd, protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and use the platform solely for your business operations during your subscription term.

You retain ownership of all Content you upload. By uploading Content, you grant BnBFlows a limited licence to host, process and display it as necessary to provide the service.

6. Your Data

We act as a data processor for the guest and staff data you manage within BnBFlows. You remain the data controller and are responsible for ensuring you have the legal basis to collect and process that data under applicable law (e.g. GDPR, Kenya Data Protection Act 2019).

We handle your data in accordance with our Privacy Policy. Upon account termination, you may export your data within 30 days, after which it will be deleted.

7. Third-Party Services

BnBFlows integrates with third-party services including M-Pesa, Pesapal, DPO Pay, MomoPay, Africa's Talking (SMS), Meta WhatsApp Cloud API, and others. Your use of these integrations is also governed by the respective providers' terms and privacy policies. BnBFlows is not responsible for the availability, accuracy or conduct of any third-party service.

8. Limitation of Liability

To the maximum extent permitted by law:

• BnBFlows is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that the platform will be uninterrupted, error-free or free from security vulnerabilities.
• BnBFlows shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business.
• Our total cumulative liability to you for any claim arising under these Terms shall not exceed the fees you paid to BnBFlows in the 3 months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. You may cancel through the account settings or by emailing support@bnbflows.com. Upon cancellation:

• Your access will continue until the end of the current billing period.
• No refunds will be issued for unused portions of a billing period.
• You have 30 days to export your data before it is permanently deleted.

We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or if required by law.

10. Disputes & Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email and/or an in-app notice at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance.
